HUKUMU UILIYOMREJESHA LEMA BUNGENI YAPINGWA NA WASOMI.

MWANAZUONI aliyebobea katika sheria, Profesa Issa Shivji na Rais wa Chama cha Wanasheria Tanganyika (TLS), Francis Stolla wamekosoa hukumu ya Mahakama ya Rufani, iliyomrejesha bungeni, Mbunge wa Arusha Mjini (Chadema), Godbless Lema.

Wakizungumza kwa nyakati tofauti juzi, wanasheria hao walisema hukumu hiyo iliyotolewa na majaji watatu wakiongozwa na Nathalia Kimaro, Salum Massati na Bernard Luanda, inapingana na sheria.

Hata hivyo, mmoja wa mawakili wa Lema, Method Kimomogoro amepinga madai hayo akisema wanaoipinga pengine hawajapata nafasi ya kuliangalia kwa undani suala la haki ya mpiga kura kupinga matokeo mahakamani.

Profesa Shivji kwa upande wake alieleza kushangazwa na maelezo ya Mahakama ya Rufani kuwa mpiga kura hana haki ya kufungua kesi ya kupinga matokeo ya uchaguzi na kusema hiyo ni sawa na kutunga sheria mpya na si kutafsiri zilizopo.
Alisema Sheria ya Bunge ya Uchaguzi, Katiba ya nchi na Mahakama, vinampa haki mpiga kura kufungua kesi kupinga matokeo ya uchaguzi.

“Sheria ya Bunge na Mahakama Kuu katika kesi ya Mgonja (Chediel ya mwaka 1980), vinampa haki mpiga kura kufungua kesi mahakamani kupinga matokeo. Sijaona hoja nzito ya Mahakama ya kufuta haki hiyo ya mpiga kura,” alisema Profesa Shivji.

Katika shauri hilo namba 84 la mwaka 1980 lililofunguliwa na William Bakari na mwenzake dhidi ya Mgonja na Mwanasheria Mkuu wa Serikali (AG), Mahakama Kuu Tanzania iliamua kuwa, mpiga kura ana haki kufungua kesi mahakamani kupinga matokeo. Walalamikaji walishinda.

Hata hivyo, Mahakama ya Rufani katika kesi ya Lema, iliamua kwamba hukumu katika kesi ya Mgonja ilikosewa kwani si sahihi kwamba mtu yeyote bila kujali mahali alipojiandikisha na kupiga kura anaweza kupinga matokeo katika jimbo lolote nchini hata kama haki zake hazijakiukwa kwa namna yoyote.

Lakini Profesa Shivji aliitetea hukumu hiyo ya Mgonja akisema imekuwapo kwa zaidi ya miaka 30 sasa na kwamba kwa muda wote huo imekuwa ikifuatwa katika uamuzi wa mashauri mbalimbali, huku akisisitiza kuwa Mahakama haiwezi kuifuta kirahisi tu.

Profesa Shivji alisema mpiga kura ni mwananchi na kwa vyovyote ana masilahi katika uchaguzi husika na hivyo anatarajia kuona uchaguzi ambao ni huru na wa haki.
“Hivyo huwezi kusema hahusiki na nani kashinda au kashindwa kwa kuwa uchaguzi ni muhimu katika kujenga na kukuza demokrasia,” alisema Profesa Shivji.

Kwa upande wake, Stolla alisema: “Nimesikiliza hata maoni ya wanasheria mbalimbali wakizungumzia kutofurahishwa na tafsiri ya Mahakama ya Rufani kuhusu haki ya mpiga kura ‘ku-challenge’ (kupinga) matokeo ya uchaguzi mahakamani,” alisema na kuongeza:
“Katika uamuzi wa kisheria, inaonekana Mahakama imetunga sheria mpya na wengi tunajiuliza kama siyo, sababu ya kuwa mpiga kura ni ipi nyingine inampa haki mpiga kura kupinga matokeo?”

Stolla alisema Sheria ya Bunge ya Uchaguzi ya tangu mwaka 1985, ambayo ilifanyiwa marekebisho mwaka 2002, kabla ya kutungwa upya mwaka 2005, inampa haki mpiga kura kupinga matokeo ya uchaguzi mahakamani.

“Mwaka 2002, sheria zote zilifanyiwa marekebisho na baadaye mwaka 2005, Bunge likatunga sheria mpya inayoitwa Sheria ya Taifa ya Uchaguzi, ikafuta ya mwaka 1985. Sheria hiyo na marekebisho yake, ndiyo inayotawala uchaguzi hadi sasa,” alisema.

Alisema hata kabla ya kutungwa kwa sheria hiyo ya Uchaguzi ya mwaka 1985, tayari kulikuwa na uamuzi wa Mahakama Kuu katika kesi ya Mgonja ambayo iliamua kuwa mpiga kura ana haki ya kupinga matokeo ya uchaguzi mahakamani.

The killer behind the horrific elementary school spree killing would have seen the children he shot dead as ‘little more than trophies’, an expert psychologist has said.
A lone gunman – believed to be 20-year-old Adam Lanza - opened fire at around 9.30am this morning at Sandy Hook Elementary School in Newtown, Connecticut.  It is understood at least 29 people have been killed – including 22 children - and is the worst spree shooting in American history.
Professor Craig Jackson, head of psychology at Birmingham City University and an expert in spree killings, said the murderer would have seen killing the children as a way of enacting revenge on those he was angry with.

‘To him the children are just a lump of meat that happen to help him prove his point,’ he explained.
‘If this was a revenge spree then he would see the children as useful trophies because each death would injure those he wanted to hurt.
 ‘This was the case in the Dunblane school massacre. Thomas Hamilton had no connection to the school but saw the killing of the children as a way to punish the community as a whole.’
It is understood Lanza killed his father before heading to the elementary school where he killed the head teacher before targeting a class his mother taught.

Professor Jackson said: ‘It is possible that this spree stemmed from a domestic row and once he had killed his father he decided to continue shooting.
'As he had already killed one person, he may have seen to keep on going as the only option.
‘But then the main question is, why shoot the children? There must have been a motive for that. He must have felt he had a grievance with the community that he wanted to punish.
‘Many spree killers target children as a way to get even with the local community.
‘I’m sure many survivors will report that he was calm and focused.  These sort of killers aren’t crazed, they know what they are doing and choose who they kill.
‘The Columbine High School massacre is an example of this, where the killers let some people go but shot others dead.
'This makes them feel powerful and in control.’ 
Professor Jackson explained that all spree killers have certain things in common – they are unstable, narcissistic, immature and consistently blame others for their failures.
He continued: ‘They often believe they should be doing better in life than they are doing and believe it is others’ fault that they are not.
‘They may believe teachers held them back, or blame their parents, but it is never their fault.
‘This outlook builds throughout their lives and then it comes to a point that something tips them over the edge.’
He said the killing of his parents points to trouble at home but the thing that sent the killer over the edge could also be down to problems at work or university.
The Batman killer James Holmes had been kicked out of his university for failing his exams shortly before his shooting rampage at the midnight screening of the Dark Knight Rises in Aurora, Colorado, on July 20.

UNAIJUA HII; SHULE YA KWANZA TANZANIA ILIJENGWA MUHEZA MKOANI TANGA!!!?

Shule ya kwanza Tanzania ilijengwa Muheza

Baadhi ya majengo yaliyojengwa shuleni hapo enzi hizo.

MWAKA 1848, Mmishenari wa Kijerumani Dk Johan Ludwig Krapf,   alitembelea kijiji cha Magila kilichopo  Muheza mkoani Tanga akiwa katika safari zake za Afrika Mashariki.
Magila kuna  mlima ulio katika safu za milima ya Usambara ukipakana na mlima wa Magoroto ambao ndio  chanzo cha maji ya mto Mkurumuzi unaoelekea Muheza.
Historia inaonyesha  eneo la mlima   Magila wenye  miamba na mawe mengi, zamani kabla ya kuja wageni  lilitumika kuwatenga wagonjwa wa ukoma na magonjwa mengine yasiyotibika, kwa lengo la kuwazuia wasiwaambukize wengine.
Dk Krapf alipofika na kuwaona wagonjwa hao  waliokuwa wakiishi kwa madhila makubwa, alichonga msalaba katika mti wa mkuyu kwa imani kuwa Mwenyezi Mungu angewaponya wagonjwa hao.
Eneo hilo ndilo lililokuja kujengwa shule ya kwanza na Waingereza mwaka 1886. Alama ya msalaba huo ipo hadi na sasa na ndipo ilipo Shule ya Sekondari  Hegongo.
Hadi leo mahali hapo panaitwa Magila Msalabani. Kwa sasa Magila ni kata yenye vijiji vya vya Magila, Mikwamba, Misongeni na Mafleta.
Nilifika katika eneo hilo nilipokuwa wilayani Muheza hivi karibuni ili kuchunguza historia ya eneo hilo.
Hapo nikutana na Luteni Kanali mstaafu John Mhina ambaye amekamilisha kuandika kitabu kuhusu historia ya Magila Msalabani,  kinachoeleza historia ya kijiji hicho na ujio wa wazungu walioanzisha shule ya kwanza Tanganyika na kanisa.
Luteni Kanali Mhina aliyelitumikia Taifa kwa muda mrefu kama mwanajeshi , na baadaye kuwa Mbunge wa Muheza kutoka mwaka 1990 hadi 1995,  anasema harakati za kuanzisha shule katika kijiji hicho zilitokana na Wamishenari waliokuja Afrika Mashariki kutoka Ulaya kwaajili ya kueneza dini ya kikristo tangu miaka ya 1770.
Anawataja baadhi ya Wamishenari hao kuwa ni pamoja na David Livingstone, Charles Mackenzie, William Tozer na Edward Steer.
Anasema harakati hizo zilianzia tangu visiwa vya Zanzibar mwaka 1863 ambako pia walikomesha biashara ya utumwa na kuanza ujenzi wa kanisa la Anglikana la Mkunazini Zanzibar kwa miaka 10 tangu mwaka 1873.
Anasema wakati huo kulikuwa na shule iliyoanzishwa Zanzibar maeneo ya Kiungani na Kiinua mguu na Askofu William Tozer mwaka 1869. Hata hivyo,  anasema shule hiyo haikuwa rasmi na ilikuwa ikifundisha elimu ya dini kwa watumwa waliokombolewa.

Pembe hizo zilizoelezwa kuwa zimetokana na tembo 39 wenye thamani ya Sh934.8 milioni, zilikamatwa juzi saa 12 jioni, baada ya gari lililokuwa na shehena ya mzigo huo kushtukiwa na askari waliokuwa katika Kituo cha Ukaguzi cha Igumbilo kilichopo Iringa Mjini.


Kamanda wa Polisi Mkoa wa Iringa, Michael Kamuhanda alisema jana: “Watuhumiwa walikamatwa kutokana na kusita kusimamisha gari lao baada ya kushukiwa na askari. Haina shaka kwamba tembo hao waliuawa katika uwindaji haramu unaodaiwa kuendelea mkoani Mtwara,” alisema Kamanda Kamuhanda na kuongeza: “Askari walipolisimamisha gari hilo, dereva alijifanya anasimama, lakini baadaye akaanza kulikimbiza ndipo polisi walipoanza kulifukuza.”


Kamuhanda alisema kutokana na gari hilo kuwa na mwendo wa kasi kuliko la polisi, walilazimika kuchukua gari la msamaria mwema aina ya Toyota Land Cruiser na kuendelea kulikimbiza.“Wakati wanalifukuza gari hilo, askari waliwasiliana na polisi wa Kituo cha Ruaha Mbuyuni ambao waliweka kizuizi.”


Kamanda Kamhanda alisema baada ya kufika eneo hilo na kubaini kizuizi hicho, dereva wake aligeuza gari hilo kwa kasi na kuanza kurudi.


Alipofika mbele kidogo, watuhumiwa walilitelekeza na kukimbilia kichakani.Kitendo hicho kiliwavuta baadhi ya wananchi waliokuwa karibu na eneo hilo na baada ya kufika hapo, walishirikiana na polisi kuingilia kichakani kuwasaka watu hao na kuwakamata muda mfupi baadaye.


Kamanda huyo alisema polisi waliokuwa wakilifuatilia gari hilo, walilipekua na kukuta pembe hizo zenye uzito wa kilo 211.6.
“Thamani ya pembe hizo ni Sh186,680,000. Lakini gharama za jumla kwa tembo 39 waliouawa ni Sh934,830,000,” alisema.


Kamanda Kamuhanda alisema mbali na kuwashikilia watu hao watatu, polisi inaendelea na kufanya uchunguzi ili kuwabaini wahusika zaidi wa uharamia huo.
“Tunaamini bado kuna watu nyuma yao, siyo rahisi hao waliokuwa wanasafirisha, kuwa ndiyo waliokuwa wamewawinda tembo hao,” alisema na kuongeza;


“Sisi tunaendelea na uchunguzi na utakapokamilika tutawafikisha watuhumiwa wote mahakamani. Si kweli kwamba hawa waliokuwa wakisafirisha ndiyo wameingia kwenye mbuga za wanyama na kuua wao wenyewe,” alisema.


Kamanda huyo alisema mbali na pembe hizo za ndovu, katika upekuzi huo, polisi walibaini aina mbili za namba za usajili wa gari lililokuwa limebeba shehena hiyo ya nyara za Serikali.
“Watuhumiwa walitumia namba mbili za gari. Wakati gari hilo linapita eneo la Igumbilo, lilikuwa na namba tofauti na zilizokutwa Ruaha. Hali hii ilifanya kazi ya kutambua gari kwa kutumia namba kuwa ngumu, lakini aina ya gari na rangi vilisaidia,” alisema

MAJAMBAZI WAPORA MAITI NA WAOMBOLEZAJI HUKO SINGIDA.

WATU wanaodhaniwa kuwa ni majambazi, wamevamia gari lililokuwa linasafirisha maiti kutoka mjini Morogoro kwenda mkoani Mara kisha kupora  takriban Sh19.8 milioni walizokuwa nazo waombolezaji.
Katika tukio hilo la kusikitisha lililotokea juzi mkoani Singida,  majambazi hao walivunja vioo vyote vya gari pamoja na jeneza lililokuwa na mwili wa Munchari Lyoba aliyekuwa mwanafunzi  wa mwaka wa tatu katika Chuo Kikuu cha Sokoine (SUA) cha Morogoro na kumpekua marehemu.
Akizungumza na waandishi wa habari jana nje ya chumba cha kuhifadhi maiti cha Hospitali ya Mkoa wa Singida, mkuu wa msafara uliokuwa ukisafirisha maiti,  Makaranga alisema kuwa tukio hilo lilitokea juzi saa 7:30 usiku katika gari aina ya Land Cruiser mali ya SUA.
Akisimulia tukio hilo, Makaranga alisema kuwa lilitokea katika Barabara Kuu ya Dodoma – Mwanza nje kidogo ya Mji wa Singida kwenye kona maarufu kwa jina la Mohammed Trans kuelekea mkoani Mara.  
Alisema kuwa gari hilo pamoja na jeneza, lililobeba viongozi wa wanafunzi sita na viongozi wengine wanne lilipofika eneo la tukio, walikuta mawe makubwa yamepangwa barabarani na kuwalazimisha kusimama ndipo wakavamiwa na kundi kubwa la vijana, ambao walibeba bunduki mbili aina ya gobore, marungu, mashoka na mawe.  
“Walipofika walipiga kioo cha gari letu kwa mbele na kumparaza kwa panga usoni dereva wetu. Baada ya hapo walivunja vioo vyote na kutuamuru kutoa kila kitu tulichokuwa nacho,” alisema Makaranga.  
Makaranga alisema kuwa katika tukio hilo, aliporwa Sh2 milioni alizokabidhiwa azihifadhi kwa ajili ya kugharimia msafara huo, Sh8.8 milioni zilizochangwa na wanafunzi kama rambirambi kwa  mwenzao na jumla ya Sh9 milioni ambazo wasindikizaji walikuwa nazo mifukoni mwao.  
“Pia tuliporwa simu  zetu zote  za mikononi, viatu, laptop na mabegi yote ya nguo zetu,” alisema.  
Makaranga aliyeeleza kuwa anafanya kazi za kiutawala SUA, aliwataja walioumizwa na majambazi hao kuwa ni pamoja na yeye, dereva wao na kiongozi wa wanafunzi, Idd Idd ambao walitibiwa katika Hospitali ya Mkoa wa Singida na kuruhusiwa.
Mkuu wa Wilaya ya Singida, Mwalimu Queen Mlozi, alithibitisha kutokea kwa tukio hilo na kueleza kuwa amewasiliana na uongozi wa SUA ili watume gari lingine na kukarabati jeneza lililoharibiwa na majambazi hao.
Mlozi aliongeza kuwa kwa ushirikiano wa Jeshi la Polisi na Kamati ya Ulinzi na Usalama, watahakikisha watu waliofanya unyama huo, wanakamatwa haraka iwezekanavyo ili waweze kufikishwa mbele ya vyombo vya sheria.  
“Nimesikitishwa sana na tukio hili, inaelekea sasa binadamu tunaanza kutoka kwenye utu na kuhamia kwenye vitendo ambavyo binadamu wa Mwenyezi Mungu hawezi kuthubutu kuvifanya. Watu wanafikia hata kufungua jeneza na kuanza kulisachi,” alisema  Mlozi akionyesha masikitiko

It is the moment every young police cadet dreams of - finally being told they've withstood the test and trials to become an officer.

Hundreds of young recruits today lined up in their finery at Bogota police headquarters in Colombia to be officially welcomed into the force.
But the heavy uniform, hat and gloves combined with the balmy 19C heat was all a bit too much for one recruit.

The woman, dressed in the traditional grey blazer, white skirt with matching gloves, ceremonial hat and staff, collapsed to the ground in the middle of the ceremony.
 

Unfortunately for the recruit, the whole episode was caught on national television as the Colombian president Juan Manuel Santos attended the event to watch the passing out parade of the new police recruits in Colombia's biggest city.

The police recruit didn't seem seriously injured by her fall and was helped up by a fellow officer.

It's not the first time young officers have struggled to keep their cool while standing to attention in a formal parade during blistering heat.

This is where the second path looks less appealing. Avram Grant isn’t going to suddenly reinvigorate the faltering energy levels of an apparently ‘small’ group of players - and his appointment could prove more trouble than it’s worth.
Benitez and Grant have a cordial relationship but how quickly this will sour under the pressure of chasing results. There will be uncertainty and conflicting ideas on who to field and how to play.
While both know the way to th Champions League final – Grant’s Chelsea beat Benitez’s Liverpool, of course, in the 2008 semi-finals – it’s doubtful they can work well together in such an environment, with the axe swinging above their heads.
The bottom line is that the arrival of Grant would fatally undermine Benitez and hasten his exit. It would not be possible for him to be more ‘Interim.’
The Spaniard’s credibility, already running on empty in the eyes of most Chelsea fans, would hit rock bottom. While Grant is more popular among the Stamford Bridge faithful, he’s hardly the charismatic ‘fixer’ that is required and not a great deal better than Benitez.

The gruesome set up of the basement dungeon in China where a married father secretly held six women as sex slaves has been revealed.
Li Hao, 35, from Henan province, was sentenced to death last week for keeping the women in his grim tiny cellar and for his role in the murder of two of them
The local government clerk was convicted on charges including murder, rape, organised prostitution and illegal detention, state-run media outlet Xinhua has reported.
A court heard how he built a dungeon in his basement where he forced the women to work as prostitutes.
Police were quoted as saying that Li coerced them to kill two others who had been forced to work as sex slaves alongside them.
Three of the women he held were given leniency for their role in the two murders.
One received three years and the two others were put on probation, according to Xinhua.
Eventually, one of the women managed to escape and she went to the police.
An investigation revealed that Li created the basement in 2009 and held the women for between two to 21 months.
During their incarceration he repeatedly raped them, forced them to have sex with other men for money and made them perform in pornographic web shows.
Before they were tricked into going to Li's dungeon, the women had all worked at nightclubs and karaoke bars.
